Course Description

This course will provide knowledge and practical skills to delegates to participate in statutory labour dispute resolution procedures related to the Commission for Conciliation, Mediation and Arbitration (CCMA) and to deal with industrial action professionally. The course will cover procedures applicable to the resolution of civil disputes, including conciliation, mediation, arbitration and judgment, together with the ethical obligations that lawyers bring to these procedures.

The Aims of the Course

The course aims to:

  • Enhance participants’ industrial relations / dispute resolution skills, including trade unionists, industrial relations practitioners, managers and legal practitioners.
  • Advanced theoretical understanding of collective and individual labour law, and this includes a large component on the technical and practical application of the theory to practice
  • Contribute to the transformation and capacity building in the labour dispute resolution sector by providing
  • Show specific skills, procedures, techniques, and practitioner characteristics needed for an efficient, effective, and equitable process in the various forms of dispute resolution.

Course Objectives

By the end of this training, delegates should be able to:

  • Appreciate the need and importance of ADR and also understand the paradigm shift in dispute resolution process
  • Situate dispute resolution processes in their wider social, political and theoretical contexts.
  • Analyse a conflict situation and to select the appropriate dispute resolution strategy
  • Separate process of decision-making from the object of the process and the final product that results from the process.
  • work effectively as a member of a team, and recognition of the value and constraints of team work
